Is an EWS Certificate Issued by an Officer Below Tehsildar Rank Valid?

If you have received an Economically Weaker Section (EWS) Income and Asset Certificate signed by a Naib-Tehsildar, Anchal Adhikari or another revenue official, you may wonder whether it will be accepted for Central Government jobs or admission. The answer depends on the officer's rank, legal authority and notification issued by the respective State or Union Territory.

According to the Department of Personnel and Training (DoPT), a Revenue Officer issuing the Central EWS Income and Asset Certificate must not be below the rank of Tehsildar. However, certain other designated authorities, such as a District Magistrate or Sub-Divisional Magistrate, are also authorised under the prescribed rules.

What Does the DoPT Rule Say?

DoPT Office Memorandum No. 36039/1/2019-Estt.(Res), dated 31 January 2019, prescribes the competent authorities and the format for the Income and Asset Certificate used for EWS reservation in Central Government employment.

The relevant categories of issuing authorities include:

  • District Magistrate (DM), Additional District Magistrate (ADM) and Collector.
  • Deputy Commissioner and Additional Deputy Commissioner.
  • Deputy Collector and specified First Class Stipendiary Magistrates.
  • Sub-Divisional Magistrate (SDM), Taluka Magistrate and Executive Magistrate.
  • Chief Presidency Magistrate, Additional Chief Presidency Magistrate and Presidency Magistrate.
  • Revenue Officer not below the rank of Tehsildar.
  • Sub-Divisional Officer of the area where the candidate and/or their family normally resides.

Can a Naib-Tehsildar Issue an EWS Certificate?

DoPT has specifically clarified this question in its EWS Frequently Asked Questions, Question No. 19.

An Anchal Adhikari or equivalent officer may issue the certificate if the officer is not below the rank of Tehsildar or is an equivalent officer recognised under the applicable State/UT notification.

If an Anchal Adhikari or Naib-Tehsildar is below the rank of Tehsildar, they should not issue the Income and Asset Certificate for Central Government EWS reservation.

Important clarification

The designation alone is not enough to determine validity. Check whether the officer is legally equivalent to the Tehsildar rank and whether the State/UT has notified that officer as a competent issuing authority. A lower-ranking officer cannot become competent merely because they work in the revenue department.

What Changed After the 2024 DoPT Clarification?

DoPTs consolidated instructions dated 28 March 2024 refer to the delegation of powers to States and Union Territories to decide which authorities are competent to issue Income and Asset Certificates for EWS reservation in Central Government posts and services.

The certificate must be issued after verification of relevant documents and following the procedure prescribed by the respective State/UT. Therefore, candidates should check the applicable State government notification and not rely only on the officer's designation.

What Should You Do If Your EWS Certificate Was Signed by a Naib-Tehsildar?

  1. Check the full name and designation printed on the certificate.
  2. Find out whether the officer is officially equivalent to Tehsildar rank.
  3. Check the State/UT government notification listing authorised EWS certificate issuing officers.
  4. Contact the issuing Tehsil, SDM office or district administration for written clarification if the rank is unclear.
  5. If the officer is not competent, apply for a fresh certificate through the authorised authority before the recruitment or admission deadline.
  6. Follow the recruitment notification for the prescribed certificate format, crucial date and verification requirements.

Will a Certificate Signed by a Lower-Rank Officer Be Rejected?

A certificate issued by an officer who is not competent under the applicable rules may be questioned or rejected during document verification. The recruiting or admitting authority may verify the certificate with the issuing authority.

Do not assume that a certificate is valid merely because it has a government seal, certificate number or online verification facility. The issuing officer must also have the required legal authority.

If you have already submitted such a certificate, contact the recruitment authority and the issuing department promptly. Do not wait until the final document verification stage.

1. Is an EWS certificate signed by a Naib-Tehsildar valid?

Not automatically. DoPT FAQ Question No. 19 says that a Naib-Tehsildar below Tehsildar rank should not issue the Central EWS Income and Asset Certificate. An equivalent officer may issue it if recognised under the applicable State/UT notification.

2. Can an SDM issue an EWS certificate?
