Who Elects the Upa-Sarpanch?

The Upa-Sarpanch is elected by the elected members of the concerned Gram Panchayat. It is not a direct public election. General voters do not cast a separate vote for the Upa-Sarpanch post.

Under Section 14(9) of the Andhra Pradesh Panchayat Raj Act, 1994, one of the members of every Gram Panchayat is elected as Upa-Sarpanch in the prescribed manner.

Who Can Become Upa-Sarpanch?

  • The candidate must be an elected member of the concerned Gram Panchayat.
  • A person who is not a member of that Gram Panchayat cannot be proposed as a candidate for the Upa-Sarpanch post.
  • A Gram Panchayat member may propose only one candidate.
  • The candidate must be duly proposed and seconded by another member.
  • The candidate must satisfy the applicable legal requirements and must not be disqualified from holding the office.

How Is the AP Upa Sarpanch Election Conducted?

The election is conducted in a special meeting of the Gram Panchayat. The main steps are as follows:

  1. Special meeting notice: Notice of the meeting is issued to the elected Gram Panchayat members.
  2. Meeting at the prescribed venue: The meeting is generally held at the Gram Panchayat office, unless an alternative venue is directed by the authorised authority.
  3. Presiding Officer: The Returning Officer appointed for the ordinary Sarpanch and Ward Member election presides over the meeting.
  4. Candidate proposal: A member may propose one of the elected members for the Upa-Sarpanch post.
  5. Seconding: The proposal must be seconded by another member.
  6. Candidate names announced: The Presiding Officer reads out the names of validly proposed and seconded candidates.
  7. Withdrawal period: Contesting candidates are given 30 minutes to withdraw.
  8. Voting: If there are two or more candidates, voting is conducted by show of hands among the members present.
  9. Counting and declaration: The Presiding Officer records the votes received by each candidate and declares the candidate with the highest votes elected.
  10. Election record: The proceedings are recorded and the result notice is published as prescribed under the rules.

How Does Voting Work in the Upa-Sarpanch Election?

The Andhra Pradesh Upa-Sarpanch election rules provide for voting by show of hands when there are two or more valid candidates.

  • Only eligible members present at the meeting participate in the voting.
  • The Sarpanch is also entitled to vote.
  • The candidates contesting for the Upa-Sarpanch post are also entitled to vote.
  • The Presiding Officer records the number of votes secured by each candidate.
  • The candidate who receives the highest number of votes is declared elected.

What Happens If Only One Candidate Is Nominated?

If only one validly nominated candidate remains for the Upa-Sarpanch post, that candidate is declared elected under the applicable rules. A contested voting process is not required in that situation.

What Happens If Two Candidates Get Equal Votes?

If two or more candidates receive an equal number of votes, the Presiding Officer draws lots in the presence of the members. The candidate whose name is drawn first is declared elected as Upa-Sarpanch.

Quorum Rules for the Upa-Sarpanch Meeting

Quorum requirements are important for the special meeting:

  • The first and second special meetings require the presence of at least one-half of the total number of Gram Panchayat members, including the Sarpanch, within one hour of the scheduled meeting time.
  • Any fraction in calculating one-half is treated as one.
  • Subsequent meetings convened for this purpose may be conducted even if there is no quorum.

Members should attend the meeting as specified in the official notice. The Presiding Officer will conduct the proceedings according to the applicable rules.

What If the Upa-Sarpanch Election Is Not Held on the Scheduled Date?

Under the applicable rules, if the Upa-Sarpanch election cannot be held on the scheduled date, the special meeting is generally held on the next day, whether or not it is a Gram Panchayat holiday. The competent election authority may also direct or permit another date for recorded reasons.

What Happens After the Upa-Sarpanch Is Elected?

Immediately after the meeting, the Presiding Officer prepares and signs the record of proceedings. A notice declaring the elected Upa-Sarpanch is published on the Gram Panchayat notice board, where available, or at a conspicuous place in the village.

Copies of the result notice are sent to the concerned authorities, including the District Panchayat Officer, District Collector, Commissioner of Panchayat Raj and State Election Commission, as prescribed by the rules. A copy is also given to the elected candidate.
